The British Parliament made some changes to the law over the next 100 years, mainly to let the commissioners of the Bankruptcy take more of the debtor’s assets, along with increasing the penalty for not obeying the law. An amendment created in 1604 actually allowed for imprisonment, as well as allowing the debtor’s ear to be cut off as penalty! By 1800, by only one vote, the United States Congress passed the first Bankruptcy Law in America. This law was similar to British Bankruptcy Law, except of course, leaving out the part where any fraudulent debtors could be sentenced to death, or torture.

Today our Bankruptcy Law started with “The Bankruptcy Act of 1898” which allowed involuntary as well as voluntary filing of Bankruptcy, as well as allowing some of the debtors to claim some exemptions, as well as removing most of the main barriers for eliminating all debts. The “Bankruptcy Act of 1978” was made, making huge changes to the American Bankruptcy code. This law existed until the rise of the Bankruptcy Abuse Prevention & Consumer Protection Act in 2005.
